TERMS & CONDITIONS The Contract for a short-term holiday rental will be between the owners of Benoronsay (referred to as “us”, “we”, “Owners”) and the person making the booking and all members of the holiday party (referred to as “you”, “your”, “Hirer”) under the following booking conditions. Scottish law will govern the Contract. The Contract will be subject to these booking conditions, and must be complied with. The person whose name is on the booking form (referred to as the “Responsible Person”) agrees to take full responsibility for ensuring that all the following Terms and Conditions are adhered to by all members of the party. The Responsible Person must personally stay at the accommodation throughout the holiday and be at least 18 years at the time of booking. The names, addresses and ages of all members of the party must be shared with the Owners on request. The person held to be responsible for the hiring party will be the person who made the booking. When you submit a booking via our online reservation system you will receive an automatically generated booking summary by email to the email address you provide in the booking form. This does not form a contract between us. A contract shall only arise when your deposit is paid and cleared. Confirmed bookings are on the basis that the property, together with associated garden is to be used for the purposes of a holiday only (not exceeding 30 days) and that occupancy is as a short-term, self-catering, holiday let only. The contract affected between the hirer and the owner of the property is in the terms agreed in Schedule 4 Section 8 of the Housing (Scotland) Act 1988 and confers on the Hirer the right to occupy the property for the period agreed for holiday purposes only. TERMS OF USE You may access the property from 16.00 on the day of arrival (earlier arrivals are strictly by arrangement only). We need this time to ensure the house is ready for your arrival after the previous guests. Please note that departure is by 10.00 on your final day (subject to following hiring terms and conditions). Again, later departures are strictly by arrangement only. On departure, you are requested to leave the accommodation in a clean and tidy condition. This includes washing up, dishwasher emptied, placing rubbish in outside bins, ensuring ovens are clean and free from grease. You undertake to use the property solely for its purpose as self-catering accommodation and to accept the Owner’s right to refuse access to the accommodation to any person, whether the Responsible Person or guest of the Responsible Person, deemed unsuitable. Causing a nuisance or disturbance to neighbours or any unreasonable behaviour may result in the Owner requiring the Responsible Person or their guests to leave Benoronsay. The period from the date when the holiday is booked to commence (Date of Entry) to the day of departure set out in the Booking (Termination Date) is the “Holiday Period”. The booking agreement confers a right to occupy the accommodation for the agreed period only. PAYMENT Bookings are confirmed on receipt of the booking and receiving the deposit of one third of the holiday cost. The balance of the rental will be due for payment 28 days before the arrival date. No entry to the property will be allowed without payment, in full, being cleared beforehand. Once you have a confirmed booking (i.e. the deposit has been paid and processed), you are responsible for the full rental cost even if you subsequently cancel. We reserve the right to cancel a booking where payment has not been received 28 days before the commencement date, in which case we treat the property as being available for re-booking and loss of deposit by the Hirer. NUMBER OF PERSONS USING THE PROPERTY Under no circumstances may more than 7 people occupy the property. We reserve the right to refuse admittance in the case of a breach of this condition. Failure to vacate at the agreed time may result in you being charged additional rental. CARE OF THE PROPERTY You are responsible for the property and are expected to take all reasonable care of its furniture, fittings and effects, in or on the property. You must leave them in the same state of repair and in the same clean and tidy condition at the end of the rental period as at the beginning. You undertake to leave the property secure if left unoccupied during the period of let. You must not use the property for any dangerous, offensive, noisy activities or carry on there any act that may be a nuisance or annoyance to the owner or other properties within the surrounding area or the farming activities. A returnable deposit of £15 per day is payable on booking. This will be returned within 2 weeks after you checkout and the property is found to be in good condition. (although we would not charge for the odd glass or plate). This also covers extra cleaning if deemed necessary. We request that any breakages or damage is made known to us, so that repair or replacement can be affected without delay. It is a condition of the let that the Hirer leaves the property and its contents clean and tidy. The Hirer is responsible for the condition of the property and its entire contents during the hire period, fair wear and tear accepted. Your vehicles and their accessories and contents, and any property and valuables you bring with you are left entirely at your own risk. If you leave any property behind we will use reasonable endeavours to return it to you, although we reserve the right to make a charge against your security deposit for any reasonable postal or courier costs. We may dispose of any unclaimed property after three months. PETS Assistance dogs are welcome free of charge. Kindly state what kind of assistance dog you will be bringing. Bring your pets favourite feeding bowls and bedding with you although we will provide some bowls and blankets. You are responsible to clean up any mess your dog leaves outside. It is recommended that you have pet insurance. CANCELLATION 100% refund 60 days before check-in 50% refund 30-60 days before check-in* Less than 30 days - no refund* *However upon receipt of written confirmation of the cancellation from the Hirer, we will endeavour to re-let the property and if successful will make a full refund minus a £50 admin fee. We highly recommend the Hirer takes out holiday insurance to cover the expense of any unexpected cancellations. Keep in mind we are on an Island and we cannot control any travel disruptions caused by ferry disruptions whether due to weather or technical issues. If we are prevented, because of circumstances out with our control regarding the property e.g. fire damage, the interruption of utility supplies from putting the property at the disposal of the hirer, the hire charges shall be refunded in full and the hirer will have no further claim against the owner. It is important to us that all visitors enjoy their holiday and every effort has been made to ensure this. However, in the unlikely event of dissatisfaction with the property or any subsequent problem, the Hirer must immediately contact the owner so that the opportunity to rectify the problem is given. Under no circumstances will any refunds be considered if the property owner has not been given the opportunity to rectify any problems during the time of the Hirer’s let.
